1. Acceptance of terms
By accessing or using the Synopticom CX platform or website, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you agree on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Account and acceptable use
To access the Platform, Clients must register an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials. You agree not to use the Platform to violate any applicable laws, collect personal data without appropriate consent, transmit viruses or harmful code, or resell access without prior written consent.
3. Data and privacy
Synopticom processes personal data in accordance with our Privacy Policy and applicable data protection law including the GDPR. Where Clients collect personal data through the Platform, Clients act as data controllers and Synopticom acts as a data processor. Clients are responsible for ensuring they have a lawful basis to collect and process personal data through the Platform.
4. Intellectual property
All intellectual property rights in the Platform remain the exclusive property of Synopticom. All data submitted by Clients to the Platform remains the property of the Client. Synopticom will not use Client data for any purpose other than providing the services, unless expressly agreed in writing.
5. Service levels
Synopticom will use commercially reasonable efforts to ensure the Platform is available 99.5% of the time in any calendar month, excluding scheduled maintenance windows. Specific SLA commitments for Enterprise clients are set out in their individual service agreements.
6. Limitation of liability
To the maximum extent permitted by law, Synopticom's total liability shall not exceed the total fees paid by the Client in the 12 months preceding the claim. Synopticom shall not be liable for indirect, incidental, or consequential damages, including loss of profits, revenue, or data.
7. Governing law
These terms are governed by the laws of the Republic of Lithuania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lithuania, unless otherwise agreed in writing.
